The paper analyses Constitutional Court's decision no. 221 of 2019, which ruled out the constitutional illegitimacy of the prohibition for same-sex female couples to have access to medically assisted procreation. The author highlights how certain elements of the ruling seem to be in discontinuity with previous rulings on medically assisted procreation, in particular with regard to the constitutional relevance of procreative needs. The paper also reflects on the impact that any development of scientific knowledge in this field may have on the discipline in question.
