Abstract:
The essay summarizes the main issues related to the configuration of the crimen expilatae hereditatis, and in particular the relationships with the usucapio pro herede, the actio furti and the acceptance of an inheritance. The essay presents a reading of D. 47.19 based on the palingenetic evaluation of each text, aimed at clarifying the evolution of the crimen and the content of Marcus Aurelius proposal mentioned in the first fragment.
