Il dialogo tra giudice comune, Corte di giustizia e Corte costituzionale dopo l’obiter dictum della sentenza n. 269/2017

The essay analyses the most recent judgments of the Italian Consitutional Court (ICC) following the obiter dictum of the decision No. 269/2017 and concerning the triangular relationships between the ordinary courts, the European Court of Justice (ECJ) and the ICC. The Author points out the differences beetwen this line of judgments and the Granital case-law and also examines the role of the ordinary courts and of the ICC in the new panorama and in their relationship with the ECJ. In the last part of the contribution, the A. suggests a new kind of relationship beetwen the ordinary courts and the ICC aimed at guaranteeing, at the same time, an effective and immediate judicial protection of fundamental rights and legal certainty.
