A Suprema Corte di Cassazione e o revirement sobre os danos punitivos na Itália: algumas anotações

The ruling n ° 16601, of July 5, 2017, can be considered one of the most important decisions of the Italian Supreme Court of Cassation in recent years. In this case the Grand Chamber ruled that the application for annulment of a judgment allowing the recognition and enforcement in Italy of foreign judgment was inadmissible and, at the same time, pursuant the art. 363, 3, Italian c.p.c. and by a revirement, has expressed a general legal principle which allows the future possibility of foreign judgments awarding punitive damages to be recognized by Italian law. And, as an assumption for such recognition, it expressly holds the multifunctional nature - mainly compensatory and, to a lesser extent, also sanctioning - of civil liability.
