Abstract:

The article examines the Italian discipline of the accident in itinere, starting from the jurisprudential elaboration to the legislative notion introduced by article 12 of Legislative Decree No. 38 of February 23, 2000, which has collected the results of jurisprudence. It is also reported that the insurance against accidents at work extends to the events that occurred along the route between worker’s house and place of work, independently of the level of risk of the route, but within the limits of reasonableness that lead the worker to the lowest degree of possible risk exposure.
