LINKING E COMUNICAZIONE AL PUBBLICO NEL SISTEMA DELLA CORTE DI GIUSTIZIA DELL'UNIONE EUROPEA

Links are the wires of the web. They play a fundamental role for economic and expression freedoms on the internet. Controlling links means controlling the way information circulate. This work is about freedom to (and control of) links under the communication to the public and making available right regime designed by the Court of Justice of the European Union. The first chapter provides for the general details of the issue, both technical, practical, and legal. The second chapter deals with links towards lawful contents. The third one addresses links targeting unlawful information. The final chapter covers the possible impact of the System of the Court of Justice upon right holders, commercial providers of links, internet service providers, and private users.
