REALTA' DEL DIRITTO. LA CONTROVERSIA SULLA NATURA DEL DIRITTO NEL DIBATTITO TRA LEON PETRAZYCKI, CZESLAW ZNAMIEROWSKI E JERZY LANDE

The thesis concerns the nature of the legal phenomenon based on the analysis of the controversy between polish philosophers: Leon Petrazycki, Czeslaw Znamierowski e Jerzy Lande. The controversy conserns two contraditory visions of the law: one substantial, that applies at the legal phenomenon the cateogory of 'res', and the second one that describes legal phenomena as 'illusions'. The thesis describes the dispute between the mentioned philosophers and applies at the character of the dispute categories of ontological, psycho-sociological, logical and metodological importance.
