Nuove prospettive per il principio di legalità in materia sanzionatoria amministrativa: gli obblighi discendenti dall'Art. 7 CEDU

The contribution, taking the cue from a judicial decision as to disqualifying sanctions in the field of the production of energy from renewable sources, investigates to what extent the application of the principles descending from the European Convention for the protection of Human Rights as construed by the Court of Strasbourg may and must trigger significant innovations in the guarantees to be ensured to citizens under administrative proceedings for the application of administrative sanctions. This through the assimilation among afflictive administrative sanctions and criminal ones and therefore, as it will be showed, the extension to the formers, among others, of the guarantees descending from the principle of legality as in force in the realm of criminal law.
