DALLA TUTELA DELLE CONFESSIONI RELIGIOSE ALLA TUTELA DEL SENTIMENTO RELIGIOSO INDIVIDUALE : L’INCOMPLETA TRASFORMAZIONE DELL’ORDINAMENTO ITALIANO

In Italy, the direct protection of religious denomination has recently been abolished in favor of a system more focused on the protection of the individual religious feelings. This modification is significant also for the criminalization of the incitement to religious hatred. The paper tries to analyze the status of the legislation and of the jurisprudence on this topic in the light of the debate around the hate speech and hate crime persecution.
