This article questions the ban on jail-guard's union legally establishe by Act 8231 in the Province fo Córdoba-Argentina. On the one hand, it specifies the most common excuses that support the ban (internal security and hierarchical principle) and then shows that those excuses have no solid bases. On the other hand, it states that there is an invasion of powers between national and provincial authorities provoked by this Act. Finally, it claims that this legislation has naturalized authoritarian ideologies of the dictatorial period and therefore calls for an ongoing discussion about public institutions' democratization.
