Abstract:
The research aimed to analyze the dismissal and other disciplinary punishments towards public employees and officials in Lombardy-Venetia Kingdom between 1816 and 1848. This is a study of legislative, doctrinal and especially archival sources in an attempt to reconstruct a subject neglected by storiography, from the eighteenth century to the present day.
The second rule of the Austrians in Italy’s political and institutional context, moreover, lacked a proper administrative jurisdiction to refer the matter in.
As a matter of fact, after Napoleonic Council of State’s abolition, the punishment of the wicked servant is entrusted to an intricate set of proceedings whose face is necessary to reconstruct.
After analyzing the ideal bureaucrat, and the powerful tools and equipment which Habsburg Monarchy could count on, large space is devoted to the resignation of state employees, under substantive and procedural point of view. Then the milder sanctions: suspension, translocation and the verbal warning.
But the gaze is also directed to the victims of the sanctions. From the study of secret reports we tried to shape the real protagonist, just to return a picture as closely as possible of deviance in the bureaucracy. Alcoholism, extramarital affairs, but also crimes against public administration, here are the most frequent charges against Hapsburg public employees in Lombardy-Venetia as attested by the numerous papers contained in State Archives of Milan. All these reflections provide fertile ground for future researchthat this survey may be a prerequisite.
