The present research analyzes the jurisprudence of the italian Constitutional Court regarding the Convention for the Protection of Human Rights and Fundamental Freedoms. Since the decisions n° 348 and 349 of 2007 the Constitutional Court assures a stronger incidence of the international treaties on the italian law system, this study aims to underline the critical points and the possible consequences of this situation, suggesting alternatives and correctives.
