The paper addresses the right to climate as a claim to ensure that the planet’s climate is no longer determined by anthropogenic activities. It discusses in particular the role attributed to judicial power in climate change litigation and its ethical-political assumptions; the eternally unfinished role of international law, which is still struggling to be the protagonist in the global climate issue; and, finally, the contentious idea of climate neutrality.
