e essay by Philipp Lotmar, ‘Der unmoralischer Vertrag, insbesondere nach gemeinem Recht’, despite having had very little echo in the literature of the twentieth century, is not only significant, from the point of view of the history of historiography, for ist its bold contents in relation to the time in the difficult definition of the fundamental task that morality shares with law, but it is also valuable for Roman Law studies: it contains an accurate review of legal evidence from within and outside the Corpus iuris civilis that can still be a point of reference for further investigation into the thought of Roman jurists on the subject.
