Discipline anacronistiche e questioni di genere all’esame della Corte costituzionale. Alcune riflessioni a margine della sentenza n. 1 del 2022, in materia di selezione del personale per convitti ed educandati

The paper analyses the decision no. 1/2022 of the Italian Constitutional Court, which declared inadmissible the question of constitutionality raised by the Court of Trapani on the genderbased selection of college educators. The paper focuses, in particular, on the reasons that the Constitutional Court offered to support its conclusion, making some critical considerations in the light of the previous case-law. Finally, the author addresses, in a general perspective, the relationship between the Constitutional Court and the Legislator and the principle of loyal cooperation between powers.
