Facebook come la RAI? : note a margine dell'ordinanza del Tribunale di Roma del 12.12.2019 sul caso CasaPound c. Facebook

This essay focuses on the issues raised by the decision through which, on the 12th of December 2019, the Civil Court of Rome ordered Facebook to reactivate the social page of the political movement CasaPound. After giving an overview of the growing trend of privatization of the censorship of content posted on social networks, an analysis of the arguments presented by the judge will be carried out. In particular, the study will focus on the issue of the legal status of a social network platform. This aims to verify the implications that the court’s appeal to the principle of pluralism as a condition and limit for Facebook in the regulation of the contract with its users has both in terms of the consistency of the logical and juridical reasoning and in terms of the protection of other constitutional rights.
