L'impossibilità di detrarre dalla pena da scontare il periodo trascorso in messa alla prova in caso di imputato minorenne: profili di legittimità costituzionale

The Author examines two recent decisions taken by the Juvenile Court of Milan and the Supreme Court, which bring to the Constitutional Court’s attention the sensitive issue relating to the possibility of taking into account the time spent on failed-probation in sentencing. In fact, this is not allowed for juvenile probation, whilst it is specifically regulated by law for adult offenders.
