Affermazione di genere e scioglimento imposto dell’unione civile. Nota a Corte cost., sentenza n. 66 del 2024

The focus of this contribution is an analysis of the Constitutional Court’s ruling, no. 66 of 2024, which censures the automatic dissolution of a civil union following the gender reassignment of one of the partners. Following an examination of the case in question, its context and the precedent set by previous cases, the paper first addresses the concerns raised by the referring court and then presents the reasoning provided by the Constitutional Court. Finally, it offers a critical analysis of the ruling itself, with particular attention paid to the implications of establishing heterosexuality as a prerequisite for civil marriage.
