Il difficile bilanciamento tra ragionevole durata ed effettività della giustizia nelle riforme alla Convenzione europea
dei diritti dell’uomo / C. Sanna. - In: STUDI SULL'INTEGRAZIONE EUROPEA. - ISSN 1970-0903. - 10:2(2015), pp. 319-343.
Abstract:
The article analyzes the most recent reforms of the European Convention of Human
Rights, developed in order to reduce the workload that has progressively overcame the
ECtHR from the Nineties. The analysis stresses, in particular, the compression of the right
to the individual application, established in order to meet the goals of fast trials. In this
perspective, it examines the innovations introduced by Protocol 14, the enforcement of the
modification of article 47 of the Rule of procedure and the reforms provided by Protocols
nn. 15 and 16, which are not entered into force yet. Finally, the article offers some thoughts
on the future of the conventional system on the basis of the Action Plan attached to the
Declaration adopted at the Brussels Conference, organized by the Presidency of the Council of Europe on 26-27 March 2015.
