abstract:
After a short introduction on the constitutional organization of Bulgaria and its democratic transition from a socialist system to a democratic model, the essay deals with the participation of the Bulgarian Parliament in the European decision-making process. The study analyzes the parliamentary procedures concerning the subsidiarity scrutiny of European legislative proposals, focusing on the reasoned opinions adopted in the area of freedom, security and justice.
The paper offers some general considerations about the direct and indirect effects produced by the subsidiarity monitoring, highlighting the progressive political empowerment of the Bulgarian Parliament (which is unicameral) in the European context. At the same time, the enhanced role of the Parliament has partly influenced the structure of constitutional powers at national level, strengthening the relation between the Chamber and the Government, which have to define a common position on European affairs. The exercise of these functions at European level has allowed the Bulgarian Parliament to create a new platform for dialogue with the Government, confirming that in Bulgaria the form of government is provided with a substantially parliamentary connotation that prevails on the formal classification as a semi-presidential system. Moreover, this increased role of the Chamber in the area of freedom, security and justice has been very useful also to define the national issues related to security and public order, which have aroused great interest, due to the serious crimes and the frequent cases of corruption that have taken place in Bulgaria.
