Abstract:
The status of sociology of law in Italian universities is quite favorable, especially as far as teaching is concerned. This may come as a surprise, since throughout the first half of the 20th century sociology as such was virtually banned from academia by the neo-idealism then dominating Italian philosophy and the Fascist regime, which prohibited all criticism of political power. This article retraces the historical roots of this cultural resistance. After the Second World War, a sociological approach to law could easily start anew because of the work of scholars who had maintained contact with foreign cultures, and, no less, the activity of a number of "pure" jurists who were engaged in interpreting pre-war laws in the light of the "spirit" of the democratic Constitution of 1948. This anti-formalist wave is explicitly open to the social sciences.
