Abstract:
The role of digital platforms — which recently have become protagonists of the digital economy — requires to think about the exact perimeter of the regulatory framework within which these subjects can operate, recognizing also the gaps that could lead to the ineffectiveness
of the discipline. Since the adoption of Directive 2000/31/EC, in fact, have emerged several information society services that were not considered by the discipline, clearly showing the dependency of our economy on digital services and highlighted both the benefits and the risks
stemming from the current framework for the functioning of digital services. It is in this context that is framed the Proposal for a Regulation of the European Parliament and of the Council on a Single Market For Digital Services (Digital Services Act), which aims at an overall
revision of the existing regulation, also trying to intercept the new manifestations of private autonomy in electronic commerce.
