The article first e xamines the general aspects of the arbitration agreement for
non-contractual disputes; it then focuses on arbitration in tort disputes, whether
arising from a contract containing an arbitration clause, or in cases where there is
no connection to a contract; finally, it identifies a limit to the possibility of referring
the dispute to arbitrators in tort cases arising from the violation of human rights
protected by the Constitution.
