Blockchain e mercato dell'arte: spunti di diritto privato

Blockchain technology seems to be used in various ways in the art field — from archives to new
forms of authentication, not to mention NFTs — and it draws the attention of market operators
and lawyers. The essay analyses the role of blockchain technology in the art market in the
perspective of private law, by dealing with two fundamental issues: the need to distinguish one
activity from another, especially by taking into consideration the form of art wich is involved in
each case, and the relationships between the subjects involved. In this context, it seems that
private law should not only regulate the tradictional conflicts of the art market, but also deal with
new asymmetries beetween parties.
