Le ragioni della diffidenza, il senso della fiducia = The Reasons for Mistrust and the Meaning of Trust

Greco’s most recent book focuses on the role that trust plays in the law and in
modern legal culture, with the meta-theoretical and prescriptive purpose of suggesting
that legal theorists change their cultural perspective by examining the fiduciary elements
presupposed by legal systems and assuming the prevalence of trustworthiness and
benign dispositions. In Greco’s view, unlike horizontal and vertical trust, coercion and
sanctions are not essential to the law. However, legal sanctions are not merely a sign
of distrust of humans’ benevolent affections, but also an instrument of predictability in
circumstances of epistemic unreliability and conflicting motivations.
