Profili di diritto sindacale e del lavoro nella composizione negoziata della crisi

This essay examines the institution of the composizione negoziata della crisi, introduced by Legislative
Decree No. 118 of 24th August 2021. The goal is to highlight the issues of trade union law and
labour law featured in the procedure. The author seeks to identify the point of contact with the Codice
della crisi di impresa e dell’insolvenza, provided for in Legislative Decree No. 14/2019, to then verify
whether the institution of the composizione negoziata della crisi protects the rights of workers. These
rights have been undermined owing to the capital or economic-financial imbalance of the company
they collaborate with, as is provided for by EU Directive No. 2019/1023, which has not been
transposed into the Italian legal system yet.
