Abstract:
The hearsay evidence is a peculiar proof and the jurists of ius commune have always looked it with suspect. But the Corpus Iuris and the canon law admit it sometimes. The canon law needs this evidence to verify if blood tie exists between wife and husband, and so if they are guilty of incest. In 1215, the decretal Licet ex quadam decreed that the witnesses and their dicta must be provided with twelve requisites to be valid in the trail: this paper examines the Glossa ordinaria by Bernardo da Parma, the glossae by Giovanni Teutonico and Vincenzo Ispano, le lecturae by Sinibaldo de' Fieschi and Enrico da Susa, the Liber cautele by Uberto da Bobbio, the ordo by Bonaguida d'Arezzo and the formularium by Ranieri da Perugia in order to understand the thought of the jurists about the use of this evidence in the trial.
